  1. Acceptance

These Terms of Use refer only to the mycommunitycinema.org.uk website site located at www.mycommunitycinema.org.uk and any other subdomains of mycommunitycinema.org.uk (“the Site”). The Site is owned by Cinema For All.

By using the Site you agree to be bound by these Terms of Use. We reserve the right to amend these Terms of Use from time to time without notice to you and you agree to be bound by any such changes in your subsequent use of the Site.

The agreement between you and Cinema For All formed on the basis of these Terms of Use (the “Agreement”) shall terminate immediately if you breach these Terms of Use. Cinema For All reserves the right to terminate this Agreement at any time. The termination of this Agreement or your right to use the Site is without prejudice to any rights which Cinema For All may have against you in respect of such breach.

  1. User Accounts

By creating a user account or cinema profile (“Account”) on the Site you are agreeing to these Terms. The person or persons who create an Account is wholly responsible for all material, content and information uploaded to it.

Cinema For All is not liable for any inaccurate information displayed on an Account, including but not limited to information surrounding location, accessibility, screenings and ticketing.

It is the responsibility of the person or persons who created an Account to ensure that images, videos, or any other material liable to copyright laws should be suitably licensed for use on the Account. Cinema For All is not liable for any breach of copyright by a user uploading content to an Account, and in the case of such a breach the user agrees to indemnify Cinema For All against any resulting losses.

Cinema For All does not guarantee that all material uploaded to an Account will be publicly displayed, and it does not need to provide a reason for certain material not being displayed. While the Site aims to send details of Accounts’ film screenings to the relevant third parties for local and national press to access, Cinema For All does not guarantee that these details will be sent to or used by any third parties..

If Cinema For All is made aware that an organisation associated to an Account is no longer in operation, it will aim to remove said Account and store any associated data in line with the General Data Protection Regulation. However, it is the users’ responsibility to update and/or remove any information on an Account that is no longer correct or relevant. For more information about data protection see Data Protection (see section 5).

While Cinema For All endeavours to keep all Accounts adhering to the Agreement live, it reserves the right to disable or terminate an Account at any point without giving notice or a reason.

  1. Intellectual Property Rights

All materials available on the Site (the “Materials”) – including but not limited to text, video, data, clips, audio clips, designs, logos, illustrations and still images – are protected by copyright, trademark, database and other intellectual property and proprietary rights and must not be used for any purpose other than educational, informational and non-commercial viewing purposes.

The Materials contained in the Site are either owned by Cinema For All or have been licensed by the Account owners to Cinema For All for inclusion within the Site. Cinema For All would like to hear from any intellectual property rights owners who are not properly identified on the Site so that we may make the necessary corrections and display the appropriate notices.   1. Disclaimers

This Site contains material which may be unsuitable for people under the age of 18. Cinema For All bears no responsibility for people under the age of 18 viewing unsuitable material on this Site.

This Site contains material which some people may find offensive. Cinema For All would like to stress that it has no intention of causing any offence and suggests that people who find material contained on the Site offensive should either not view the material in question or should not visit the Site. Cinema For All bear no responsibility for any offence that may be caused by people viewing the Site.

The Site includes a database of community cinemas and their screenings. Cinema For All and the Site hosts details of these events, but bears no responsibility for listed organisations or events.

Cinema For All makes no promise that the Site will meet your specific requirements or that the Site will be uninterrupted or error free.

Cinema For All may discontinue, modify and update the Site from time to time with or without notice to you and without liability to you or any third party.

Due to the nature of the internet and the fact that your access to the Site involves features outside Cinema For All’s control, Cinema For All is not responsible for technical problems you may experience with the Site. The Site is provided by Cinema For All without any warranties or guarantees. You must bear the risks associated with the use of the Internet.

You understand and agree that Cinema For All does not guarantee the accuracy or completeness of any information in or provided in connection with the Site. Cinema For All is not responsible for the results obtained from the use of such information from the Site.

To the full extent allowed by applicable law, by using the Site you agree that Cinema For All will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to your use of the Site.

Nothing in these Terms and Conditions shall exclude Cinema For All’s liability for personal injury or death caused by its negligence.

As a convenience to users of the Site, the Site includes links to other web sites or material which are beyond its control. Cinema For All is not responsible for content on Internet pages outside the Site.

  1. Data Protection

Cinema For All collects all information submitted by a user upon the creation of an Account, as well as details of when an Account is logged into. We will only keep your personal data as long as it is necessary and useful, and where we have a legitimate interest in processing the data, or you have given your consent. For further information on our overarching Data Protection, Privacy and Retention Policy and General Procedure please contact us (see section 7).

Cinema For All will not share users’ information for marketing purposes with companies outside Cinema For All and will not disclose any information to any company outside Cinema For All except to help prevent fraud, or if required to do so by law.

Any non-personal information submitted by a user related to their cinema including but not limited to address, email address and phone number, may be displayed publicly on the Site.

Users of the Site have the right to request a copy of all personal data that Cinema For All holds about them and can do this by contacting us (please see How To Contact Us). Users may request that their information is corrected or removed at any time.

If an Account is deactivated or removed either by its user or by Cinema For All, any associated personal data will be anonymised after two years and stored in line with GDPR guidelines.

  1. General

English law shall apply to these terms, notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. The place of performance shall be England.

Cinema For All makes no warranty or guarantee that the Site or information available over it complies with laws other than those of England.
